What the EUDR requires and where economic risk remains

The EUDR defines which information companies must collect and retain. It does not necessarily tell them where affected material went after entering their operations.

1 · Compliance

Meet your role-specific obligations

The applicable duties depend on whether a company is the operator first placing or exporting a product, or acts further downstream.

Operators placing relevant products on the market or exporting them

  • Collect the required information about the product, quantity, origin, geolocation, production and applicable laws.
  • Assess the risk of deforestation, forest degradation and illegality, and mitigate any risk that is not negligible.
  • Submit the required due diligence statement before placing or exporting the product and retain the supporting records for five years.

Downstream operators and traders

  • Collect information about direct suppliers and business customers, including the DDS reference or declaration identifier when supplied directly by an operator.
  • Retain the required information for five years and provide it to the competent authority upon request.
  • Act on substantiated concerns and immediately inform the competent authorities and downstream business partners when required.

For downstream companies, the legal record-keeping duty focuses on incoming product flows and direct business partners. DDS references do not generally have to be linked to outgoing product flows.

Reduce the economic risk caused by the EUDR

Compliance alone does not limit the impact of the EUDR.

If an origin, supplier or due diligence statement is later questioned, the critical issue is knowing exactly which materials, products and customers are affected.

If an input may be affected by an EUDR issue, every batch, finished product, shipment and sale that could contain or derive from it must be included in the investigation.

The affected scope can be narrowed only when auditable traceability records prove that specific goods and customer deliveries are not connected to that input. Without this evidence, one issue can quickly expand into broad stock holds, customer notifications and operational disruption.
